Infracademy Terms of Use
1. Introduction
These Terms of Use (“Terms”) govern your access to and use of the Infracademy e-learning platform, mobile applications, websites, and related services (the “Services”) provided by VOS BV, a company incorporated in Flanders, Belgium, operating under the brand name Infracademy (“Infracademy”, “we”, “us”, or “our”).
By creating an account, accessing, or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, including our Privacy Policy, which forms an integral part of this agreement.
If you do not agree to these Terms, you must not use our Services.
2. Who May Use the Services
You may use the Services only if you:
- Are at least 13 years old, or the legal age of digital consent under your country’s law (Article 8 GDPR);
- Can form a legally binding contract with VOS BV; and
- Comply with these Terms and applicable laws.
Accounts created or used in violation of these requirements may be suspended or terminated without notice.
3. Account Registration
To access most features, you must create an account by providing accurate and complete information. You agree to:
- Maintain the confidentiality of your login credentials;
- Not share your account with anyone else;
- Promptly update your information if it changes; and
- Notify us immediately at support@infracademy.org of any unauthorized access.
You are responsible for all activities conducted under your account.
4. Our License to You
Infracademy grants you a limited, personal, non-transferable, non-exclusive, and revocable license to access and use the Services solely for lawful educational purposes.
You may not:
- Copy, modify, or redistribute the platform software or materials;
- Circumvent security or usage controls;
- Use the Services for commercial gain without written permission from VOS BV.
5. Content and Intellectual Property
5.1 Platform Content
All platform content—including course materials, text, graphics, logos, software, videos, and AI-generated learning aids—is owned or licensed by Infracademy or its partners. It is protected under the EU Copyright Directive (2019/790) and Belgian copyright law.
You are granted a limited license to use such content for personal educational purposes only. No transfer of intellectual property rights occurs.
5.2 User Content
You retain ownership of content you submit (assignments, forum posts, messages, etc.).
By submitting content, you grant Infracademy a non-exclusive, worldwide, royalty-free license to host, reproduce, and display such content for educational, operational, and promotional purposes related to the Services.
Infracademy reserves the right to remove any content that violates these Terms, applicable law, or our Honor Code.
6. AI, Research, and Learning Analytics
Infracademy uses artificial intelligence (AI) and learning analytics to personalize education and improve course quality.
By using the Services, you acknowledge and agree that your anonymized or pseudonymized data may be used for:
- Improving educational recommendations and assessments;
- Academic research in compliance with Recital 159 GDPR; and
- Detecting academic dishonesty.
We do not use AI-based decisions that produce legal or similarly significant effects without human oversight (Article 22 GDPR).
7. Academic Integrity and the Infracademy Honor Code
Infracademy maintains high academic and ethical standards. By using the Services, you agree to the following Honor Code:
- Original Work: You will submit only your own work, except where collaboration is explicitly permitted.
- No Cheating: You will not use unauthorized materials, AI tools, or assistance to complete assessments unless expressly allowed.
- No Plagiarism: You will not copy or reproduce others’ work without proper attribution.
- No Impersonation: You will not allow anyone else to access your account or complete work on your behalf.
- Respect and Conduct: You will treat all instructors, peers, and staff respectfully, and not post offensive, defamatory, or illegal content.
Violations of the Honor Code may result in disciplinary action, including:
- Revocation of certificates;
- Account suspension or termination;
- Notification to your organization or partner institution; and
- Legal action under applicable Belgian or EU law.
8. Payment, Refunds, and Right of Withdrawal
8.1 Payment Terms
Certain Services (e.g., certificates, specialized courses) require payment. Fees are shown in euros (EUR) and include applicable Belgian VAT unless stated otherwise.
Payments are processed by secure third-party providers acting as independent controllers.
8.2 Refund Policy
In accordance with Directive (EU) 2019/770 on digital content and its Belgian transposition:
You have a 14-day right of withdrawal from the date of purchase unless:
- (a) you requested immediate access to digital content, and
- (b) acknowledged you lose the right of withdrawal once access begins.
To exercise your right, send an email to billing@infracademy.org or contact us through your account dashboard. We will reimburse all payments using the same payment method within 14 days.
Refunds will not be granted for:
- Completed courses or certificates already issued;
- Violation of our Honor Code or Terms;
- Subscriptions cancelled after renewal date.
8.3 Subscription Renewals
Subscriptions renew automatically unless cancelled before the renewal date. You can cancel at any time via your account settings.
9. Data Protection
Your personal data is processed in accordance with our Privacy Policy and the General Data Protection Regulation (EU 2016/679).

10. Security
We take security seriously. You must not attempt to:
- Gain unauthorized access to our systems;
- Distribute malware or interfere with Services;
- Circumvent authentication or encryption.
Infracademy employs reasonable safeguards under Article 32 GDPR, but no online system is completely secure.
11. Third-Party Services and Content
Our Services may include links to third-party websites or tools.
Infracademy is not responsible for:
- The content, privacy, or practices of third parties;
- Any loss arising from their use.
Use of such services is at your own risk and subject to the providers’ own terms.
12. Education Research and Analytics
We may use de-identified learning data for pedagogical research consistent with EU research-ethics standards and Recitals 159–162 GDPR.
Findings are reported at the aggregate level; no personal information is published without your consent.
13. Digital Services Act (DSA) Transparency
In compliance with the Digital Services Act (Regulation (EU) 2022/2065), Infracademy provides:
- A mechanism to report illegal content;
- A structured appeal process for moderation decisions; and
- Annual transparency reporting.

14. Limitation of Liability
To the fullest extent permitted by Belgian and EU law:
- Infracademy is not liable for indirect, incidental, or consequential damages, or lost profits.
- Our total aggregate liability shall not exceed the total fees paid by you in the 12 months preceding the claim.
- Nothing in these Terms limits liability for fraud, willful misconduct, or personal injury caused by negligence.
15. Indemnity
You agree to indemnify and hold harmless VOS BV (Infracademy), its directors, and affiliates against any claims, damages, or expenses arising from:
- Your breach of these Terms;
- Your unlawful use of the Services; or
- Any infringement of third-party rights resulting from your content or conduct.
16. Termination
Infracademy may suspend or terminate your access at any time for:
- Breach of these Terms or the Honor Code;
- Legal or regulatory reasons;
- Platform misuse.
Upon termination, licenses granted to you cease immediately.
17. Dispute Resolution and Governing Law
These Terms are governed by Belgian law.
Disputes shall be subject to the jurisdiction of the courts of Brussels, unless mandatory EU consumer protection rules grant you the right to bring proceedings in your home country.
You may also use the EU Online Dispute Resolution (ODR) platform for out-of-court resolution.
18. Changes to These Terms
We may update these Terms from time to time.
Material changes will be communicated by email or platform notice. Continued use after updates constitutes acceptance of the revised Terms.
